ROSEBORO - NO RELIEF
Judge James Cullen has denied the post sentencing motion by the defense in the Michael Roseboro murder conviction. In an opinion filed today, the Judge ruled there will not be a hearing with any jurors nor will Roseboro get a new trial. The Judge has granted Roseboro no relief.

Is there anything else the Roseboros can do at this point? I’m not sure how many different levels of appeal there are in our system and what the conditions are to appeal. Would it take some extraordinary new evidence or something to even have a sniff of an appeal? Just asking because like I said, I have no idea how it all works. Hopefully I never find myself in this situation to begin with!

I wish I could answer your questions. I believe that you are right that at this point, it would take something extraordinary.

New evidence from now until the end time could bring a new trial. But aside from that he can appeal his conviction to the state and supreme courts, but he needs to bring up specific points in order to be heard, and only those points can be heard. An example would be if the trial court erred in not suppressing evidence illegally collected at the crime scene; or the trial court failed to allow a certain witness to testify who could have changed the course of the trial; or ineffective counsel (always the most popular). There is a time limit and it is costly. Basically, unless he finds a golden egg, he’s screwed.

He may have a golden egg…..and depleting it of it’s contents daily.
Mike may have the ability to battle this until the end of time, if the funds are there to support the fight.
I believe a 21 page report from the judge will end this madness. I cannot imagine how much information is included in this report.

Jan’s family must be so relieved! I don’t know why it took the judge so long - but it really is pretty much over - as over as it can be.

Well said Concerned, I hope he gets screwed hard and often! I also hope that his parents will now stop funding the attorneys and provide for the children.

Isn’t Mike broke at this point? Do you think he’s able to pay for appeals?

Hopefully, this is over and his parents will put funds they made in selling the funeral home into a fund to support his children and send them to college, etc. (Even the “love child”) That child never asked for this. The children are the victims.

I also am glad that this saga is over with ! I agree with you buddy. The children should be the ones that should be priority now. Hopefully they can with God’s help learn that life is hard at times and take this situation and make something really good come out of it for themselves. Mike is a monster and deserves to be where he’s at .

At this point in time, after everything Mike has done to family and friends, life outside the big house will be worse than prison life.
Mike will always be known as a MURDERER, a CHEATER, LIAR etc……the list goes on. AT least in prison, he is with people just like him. Life in prison is THE option for him.
I agree with the above posters, I hope the roseboro’s focus on the health and welfare of the children, and themselves. The have so much much work to do, like working through their own emotions, ACCEPTING this entire situation…..GREIVING once again.
I wish there was something we all could do to help them in this next phase of life.

The children are always the one to get hurt the most in these situations. they are the innocent victims, and it is alway hard for them to fully understand the whys, as far as what has happened. They end up emotionaly messed up which always seems to affect the person they will be as adults, as far as trusting others and their attitude toward life. At least they had SOLID evidence against Mike. God Bless all children that go through horrific times at the hands of their parents actions.
