A MISTAKE ON THE DOSAGE?
Posted on January 29th, 2010 18 commentsWHAT REALLY HAPPENED?
“The motive? She wanted to ease his discomfort. It’s not a complicated motive, she just wanted him to get some rest. And she made a mistake on the dosage
“There were many tears,” the juror said. “But that’s what we believed happened.
An anonymous juror quoted in today’s article by Janet Kelley, “Juror explains nurse’s conviction,” (click here).
I’m not buying anything in this story for numerous reasons. And there is not one mention of the JusticeForJoy website (click here) and the outpouring of support and her over 800 Facebook fans. What a disgrace!
Please check back later today…

The whole damn article stinks to high heaven.Morphine is easy to get.especially since the mom was at the hospital w/ that kid during his operation.I still think the mom did it.w/ that extra monitor in her bedroom, she was sneaky. If that jury even thought Joys ex was credible they aren’t.The mom was hiding the fact the she wanted him fed more then the Dr’s orders.Bayda had to call and tell her they have to follow rules.Who cares if they cried on the stand.Lots of ppl do,doesn’t prove a thing…maybe they were crying cause she new what she did was wrong!.I hope those jurors have many sleepless nights wondering if they did the right thing, following the letter of the law.

Becky,
I was thinking the same thing. They don’t mention the justice for Joy web site, but yet do you remember when she had a friend blogging for her? It did not take long for LNP to have a article on that, which ended up having to get shut down after LNP published the article. -

I wouldn’t know the first place to get morphine illegally. But I also don’t think the whereabouts of morphine aquisition should even be a deciding factor in the jury’s decision. It should be (ref. law.com):
Reasonable Doubt
n. not being sure of a criminal defendant’s guilt to a moral certainty. Thus, a juror (or judge sitting without a jury) must be convinced of guilt of a crime (or the degree of crime, as murder instead of manslaughter) “beyond a reasonable doubt,” and the jury will be told so by the judge in the jury instructions. However, it is a subjective test since each juror will have to decide if his/her doubt is reasonable. It is more difficult to convict under that test, than “preponderance of the evidence” to decide for the plaintiff (party bringing the suit) in a civil (non-criminal) trial.
Is there any proof that someone didn’t break into the house and inject the kid with morphine? Far-fetched, yes, but it’s reasonable enough to say that without proving she was in the room at the time of the injection and/or his death, then someone else, ANYONE ELSE, could have done it.
-
My impression from reading the juror explanation was that they made the decision based on their reasoning and not any of the so called evidence given during the trail. It’s to bad the “reporter” didn’t ask any follow up questions.

I question why the agency would have to beg this nurse to take the job and offer a $75 bonus. This says no one else would take the job. Why? I also like the juror’s emphatic assertions that they were such wonderful parents. Anyone who watches any of the reality crime shows, Dateline, 48hrs, knows that the victim’s family insists that the spouse was the best, the deceased and the spouse shared a love like they had never seen before-until the evidence proves otherwise. Does Susan Smith ring a bell? And to surmise this wonderful parent scenario from their own tearful testimony of what “trouble and expense” they went to for the kid and what a vibrant life the kid had just is incomprehensible to me. This juror is gullible at the least. He probably is one of the finalists in the Publisher’s Clearing House contest. People comment on the wealth of this family-where did the money come from? I’m just curious, did they sue the Dr. who delivered the kid? And why didn’t he wonder why the mother insisted the nurse keep her distance from the kid? Never heard of such a setup before. In most cases they want you on top of the patient vigilant and attentive of any sign of want or need.

Anonymous: I know what you’re saying, but it’s really not that uncommon to offer a home nurse a bonus. When my grandmother fell ill with lung cancer we had the hardest time keeping the same nurse, we paid them directly. Because it was so hard to find a live in nurse we went with a home nursing company called HNS. We had a regular nurse M-F. On the weekends we got the same nurse as well, she was part time. When either one of them were unable to come in the nursing company would send another nurse. It was very difficult to get a nurse to live in a strange house for a weekend so they offered them a bonus.
As far as the parents go, that’s a tough thing to draw a conclusion on. I don’t think I’ve ever heard of any consistencies with parents that kill their children, except that they all lie. I’m not so convinced the parents killed their child. But I’m DEFINITELY not convinced Joy did it either. When talking about motive and opportunity there is way too much doubt to point a finger at anyone.

What do these comments have to do with ‘what really happened?”

I apologize. There are some nights we like to have some fun and there may not be an appropriate thread. I will try to resolve this tomorrow. The seriousness of this case is in no way lost on me. Sorry.

There is a new Facebook page that is supporting the Weavers. I was invited to join. I am not. I don’t think they are guilty. Just hating this whole “jump on MY bandwagon” thing.

Buddy, how do I find that website??

Parents getting medicine at the hospital…lol…that’s the most ridiculous thing I’ve ever heard. Apparently you don’t understand the steps the hospital/nurses take to keep the medicine in the nurses hands only.
Find the website to harass people? This has been debating way too much. The Maffimuk on LNP said it best when she/he commented on the juror’s article.
